The module “Civil Regulation of the Right to Collect and Disseminate Information” within the discipline “Comparative Civil Law” (specialty 293 International Law) was completed in the spring semester of the 2023-2024 academic year. The module was taught as part of an educational project with a scientific component “EU Standards on Freedom of Expression and Information (101127062)” (Jean Monnet Chair of the Erasmus+ program funded by the European Union).
The module covers the students’ study of the European experience of civil law regulation of the right to collect and disseminate information, as well as the procedure and methods of protecting public and private interests in case of violations of the right to collect and disseminate information.
The lectures and practical classes discussed the nature of disinformation, defamation and measures to counteract them, the concept of personal and confidential information, the right to protection of private life and reputation, protection of privacy in the civil law of foreign countries, protection in case of dissemination of false information, the right to reply as a way to protect honor, dignity and business reputation, peculiarities of protecting the reputation of public figures, and the right to be forgotten. The students were particularly interested in analyzing the case law and practice of the ECHR on defamation disputes, as well as disputes arising from violations of the right to freedom of expression and information. Special attention was paid to the protection of honor, dignity and business reputation under Ukrainian civil law.
