International Law student Yaroslav Berhilevych was selected to participate in the project supported by the German Academic Exchange Service DAAD Internationaler Moot Court – Enforceability of Constitutional Law, Methodology, Content, and Procedure.
The project, which was aimed at improving the professional knowledge and skills of students from Germany, Ukraine, and Kazakhstan, involved a long preparatory work, online meetings, and the final event – a team competition in the Moot Court format (December 12-17, 2022) at the Heinrich Heine University of Dusseldorf. It is also worth noting that the entire project was conducted in German, so it was an excellent opportunity for Ukrainian and Kazakh students to improve their knowledge of comparative law and language skills and gain experience in international communication
The participants of the competition were divided into two teams. Each team consisted of two students from Ukraine, two from Kazakhstan, and one from Germany. The case provided for processing, concerned the cancellation a political party funding and the recognition of its activities as contrary to the Constitution. Team A, which included Yaroslav Berhilevych together with representatives of the National Aviation University (Ukraine), the University of Dusseldorf, the Kazakh-American University in Almaty, and the M. Narikbayev KAZGUU University, had the task to appeal the decision to cancel the funding of the party and to protect its right to political activity. Team B had the opposite charge and proved the legitimacy of its actions to withdraw funding. The format of the Moot Court did not provide for the determination of winners and losers. However, we are pleased to note that the authoritative international jury found the arguments of Team A more convincing and ruled in its favor.
